Waste Disposal Highbury Service Terms and Conditions

These Terms and Conditions set out the basis on which Waste Disposal Highbury provides waste collection and disposal services in the United Kingdom. By booking a waste collection or related service with us, you agree to be bound by these Terms and Conditions. Please read them carefully before making a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means any individual, business, organisation, or other entity that requests or receives services from Waste Disposal Highbury.

Services means any waste collection, removal, transportation, recycling, or disposal services provided by Waste Disposal Highbury.

Waste means any items, materials, or substances presented by the Customer for collection and disposal, including but not limited to household waste, commercial waste, bulky items, and recyclable materials, subject to the exclusions and restrictions in these Terms and Conditions.

Contract means the agreement between the Customer and Waste Disposal Highbury for the provision of Services, comprising these Terms and Conditions and any written confirmation or schedule issued by us.

2. Scope of Services

Waste Disposal Highbury provides waste collection and disposal services to residential and commercial customers within its operating area. The specific Services, including frequency of collections, type and volume of waste accepted, and any additional options, will be agreed at the time of booking.

We reserve the right to refuse to collect any Waste that is not presented in accordance with these Terms and Conditions, that is unsafe to handle, or that is prohibited by applicable waste regulations.

3. Booking Process

3.1 A booking for Services can be made by contacting Waste Disposal Highbury using our designated booking channels. At the time of booking, the Customer must provide accurate information regarding:

a. The collection address and contact details.

b. The type of property and access requirements.

c. The nature, type, and approximate volume or weight of the Waste.

d. Any special handling requirements for the Waste, where known.

3.2 All bookings are subject to availability and confirmation by Waste Disposal Highbury. We will provide the Customer with a booking confirmation, which may include the scheduled date or collection window, the agreed price or pricing basis, and any specific conditions.

3.3 The Contract between the Customer and Waste Disposal Highbury is formed when we issue our booking confirmation. We may refuse a booking at our discretion, including where the requested Service is outside our service area or where the Waste is not suitable for collection.

4. Customer Responsibilities

4.1 The Customer is responsible for ensuring that:

a. Access to the collection point is safe, unobstructed, and available at the agreed time.

b. Waste is presented in a safe and secure manner, contained in suitable bags, bins, containers, or bundles, as applicable.

c. No prohibited or hazardous materials are included in the Waste, unless explicitly agreed in writing as part of a specialist service.

d. Any required consents or permissions from property owners, landlords, or local authorities for collection from the premises have been obtained.

4.2 If the Customer fails to provide the access or information required for safe and lawful collection, Waste Disposal Highbury may cancel or postpone the collection, and a call-out or cancellation charge may apply.

5. Service Times and Access

5.1 Collection times are given as estimates or time windows. While we make reasonable efforts to attend within the agreed period, we cannot guarantee exact times due to traffic, previous jobs, and other operational factors.

5.2 The Customer must ensure that Waste is ready for collection from the start of the agreed collection window and remains accessible for the duration of that period.

5.3 Where access is not possible due to circumstances at the Customer’s property, including locked gates, blocked driveways, or unsafe conditions, we may charge a missed-collection fee and rearrange the collection at our discretion.

6. Pricing and Payments

6.1 Prices for our Services may be quoted as fixed fees, per-load, per-item, or based on estimated volume or weight. The applicable pricing basis will be confirmed at the time of booking.

6.2 Unless otherwise stated, all prices are quoted in pounds sterling and may be subject to VAT or other applicable charges in accordance with UK law.

6.3 Payment terms will be confirmed during the booking process. We may require payment in full at the time of booking, at the point of collection, or on invoice, depending on the type of Customer and Service.

6.4 We accept payment by the methods notified to the Customer at booking. All payments must be made in full and cleared funds by the due date. Waste Disposal Highbury may withhold or suspend Services if payment is not received.

6.5 If the actual volume, weight, or nature of the Waste differs from that described by the Customer when booking, we reserve the right to adjust the price accordingly. Where possible, we will inform the Customer of any price change prior to completing the collection.

7. Cancellations and Amendments

7.1 The Customer may cancel or amend a booking by contacting Waste Disposal Highbury using our published contact details.

7.2 If the Customer cancels a booking with sufficient notice, no cancellation fee may apply. The required notice period will be confirmed at the time of booking and may vary depending on the nature and size of the Service.

7.3 Where the Customer cancels a booking without sufficient notice, or fails to present the Waste for collection as agreed, Waste Disposal Highbury reserves the right to charge a cancellation or missed-collection fee to cover costs incurred.

7.4 We may cancel or reschedule a booking due to circumstances beyond our reasonable control, including severe weather, vehicle breakdown, staff illness, or regulatory restrictions. In such cases, we will make reasonable efforts to notify the Customer and arrange an alternative collection time. Waste Disposal Highbury will not be liable for any losses arising from such changes, subject to section 11 below.

8. Waste Types and Prohibited Materials

8.1 Waste Disposal Highbury will only accept and collect Waste that is lawful to transport and dispose of under applicable UK waste regulations, and that falls within the categories agreed at the time of booking.

8.2 The Customer must not place the following, without prior written agreement, in the Waste for collection:

a. Hazardous waste, including but not limited to asbestos, chemicals, solvents, oils, paints, and medical or clinical waste.

b. Gas cylinders, pressurised containers, or explosives.

c. Electrical and electronic waste, unless specifically included in the agreed Service.

d. Liquids, including fuels, contaminated water, or other fluid substances not permitted by law.

e. Any substances classified as dangerous goods under applicable legislation.

8.3 If prohibited materials are discovered in the Waste after collection has taken place, Waste Disposal Highbury may charge additional fees for their handling, return, or specialist disposal, and the Customer may be liable for any associated fines or regulatory penalties.

9. Waste Handling, Recycling, and Disposal

9.1 Waste Disposal Highbury will handle, transport, recycle, and dispose of Waste in accordance with applicable UK waste management legislation and best practice.

9.2 We are committed to diverting Waste from landfill where reasonably practicable through reuse and recycling, subject to the nature and condition of the materials collected and the facilities available.

9.3 Title to and responsibility for the Waste will transfer from the Customer to Waste Disposal Highbury at the point of collection, except where prohibited materials or misdescribed Waste have been provided, in which case the Customer may remain responsible as set out in these Terms and Conditions.

10. Customer Warranties

10.1 The Customer warrants and represents that:

a. They have full authority to arrange for the collection and removal of the Waste from the premises.

b. The Waste presented is accurately described and does not contain prohibited materials, unless expressly agreed as part of a specialist service.

c. All information provided to Waste Disposal Highbury is complete and accurate to the best of their knowledge.

10.2 The Customer will indemnify Waste Disposal Highbury against all claims, losses, damages, costs, or expenses arising from a breach of these warranties, including any regulatory or third-party claims relating to misdescribed or unlawful Waste.

11. Liability and Limitations

11.1 Nothing in these Terms and Conditions limits or excludes Waste Disposal Highbury’s liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited or excluded under applicable law.

11.2 Subject to clause 11.1, Waste Disposal Highbury will not be liable to the Customer for:

a. Any indirect, consequential, or economic loss, including loss of profit, loss of business, or loss of opportunity.

b. Any loss or damage arising from delays, cancellations, or missed collections where we have used reasonable care and skill and acted in accordance with these Terms and Conditions.

11.3 Waste Disposal Highbury’s total liability to the Customer for all claims arising under or in connection with a Contract, whether in contract, tort, negligence, breach of statutory duty, or otherwise, will be limited to the total price paid or payable by the Customer for the specific Service giving rise to the claim.

11.4 The Customer is responsible for protecting any fixtures, fittings, or surfaces that may be affected by the movement of Waste through the premises. While we will use reasonable care and skill, we are not liable for minor scuffs, marks, or damage that could not have been avoided with reasonable handling in the circumstances.

12. Insurance

12.1 Waste Disposal Highbury maintains appropriate insurance cover for its operations in line with industry standards and legal requirements.

12.2 Customers are encouraged to maintain their own insurance for their property and items stored on it, as our responsibility is limited as set out in these Terms and Conditions.

13. Data Protection and Privacy

13.1 Waste Disposal Highbury will collect and process personal data relating to the Customer for the purposes of managing bookings, providing Services, processing payments, and fulfilling legal obligations.

13.2 We will handle personal data in accordance with applicable UK data protection laws. Customer details will be kept secure and will not be shared with third parties except where necessary for the provision of Services, for legal or regulatory reasons, or where the Customer has consented.

14. Complaints

14.1 If the Customer is dissatisfied with any aspect of our Services, they should contact Waste Disposal Highbury as soon as reasonably practicable, providing full details of the issue.

14.2 We will investigate complaints in a timely manner and, where appropriate, offer a remedy which may include re-performing the Service, issuing a partial refund, or other appropriate resolution.

15. Changes to Terms and Conditions

15.1 Waste Disposal Highbury may update or amend these Terms and Conditions from time to time to reflect changes in the law, regulatory requirements, or our business practices.

15.2 The version of the Terms and Conditions in force at the time a booking is confirmed will apply to that Contract, unless a change is required by law or regulatory authority.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions, and any Contract between the Customer and Waste Disposal Highbury, are governed by and construed in accordance with the laws of England and Wales.

16.2 The courts of England and Wales will have exclusive jurisdiction to settle any disputes or claims arising out of or in connection with these Terms and Conditions, their subject matter, or their formation.

17. General Provisions

17.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision will be deemed deleted, and the remaining provisions will continue in full force and effect.

17.2 No failure or delay by Waste Disposal Highbury in exercising any right or remedy under these Terms and Conditions will constitute a waiver of that or any other right or remedy.

17.3 The Customer may not transfer or assign their rights or obligations under any Contract without the prior written consent of Waste Disposal Highbury. We may assign or subcontract our rights and obligations where necessary for the efficient delivery of our Services.

17.4 These Terms and Conditions, together with any written booking confirmation or schedule, constitute the entire agreement between the Customer and Waste Disposal Highbury in relation to the Services, and supersede any prior discussions, correspondence, or understandings.
